General terms – Toer Eend Friesland

1. Definitions

Lessor: Toer Eend Friesland, Appelhôf 19, 8465 RX Oudehaske, email: info@toereendfriesland.nl, phone: 06-83250898. Chamber of Commerce: 42040958 · VAT: NL005449761B80.
Renter: the natural person or legal entity renting a vehicle.
Vehicle: a classic Citroën 2CV (Duck) from the Lessor's fleet.

2. Booking & confirmation

  • Bookings can be made via the booking page or by email/phone.
  • A booking is final after written confirmation by the Lessor (by email).
  • The Lessor may refuse a booking in case of incorrect details or when conditions are not met.

3. Rental period

  • Day rental: standard from 10:00 to 17:00, unless otherwise agreed.
  • Late return will result in an additional charge of €25 per commenced hour, unless otherwise agreed in advance in writing.
  • Multi-day rental is possible upon request; deviating times are stated on the confirmation.

4. Rates, deposit and payment

  • Rates are listed on the website. The wedding package is available at the published day price.
  • The rental sum is paid in advance via the payment link sent by the Lessor. The booking is only confirmed upon receipt of full payment.
  • A security deposit of €250 per rented Duck is required at the start of the rental (so € 500 for 2 cars, etc.). This is paid by bank transfer at the latest at key handover, to the account listed in the customer portal, quoting the booking number.
  • The deposit will be refunded within 7 working days after the rental period, provided the vehicle is returned undamaged, clean and with a full tank and there are no outstanding costs.
  • The Lessor is entitled to retain (part of) the deposit to offset: damage to the vehicle, missing fuel, late return costs, outstanding fines or other costs incurred by the Renter. The Lessor will notify the Renter in writing within 7 working days.
  • If damage or costs exceed the deposit, the Lessor reserves the right to recover the additional amount from the Renter.

5. Driver's licence & driver(s)

  • The driver is at least 24 years old and has held a valid category B driving licence for at least 1 year.
  • Only pre-registered drivers are permitted to drive the vehicle.
  • The Renter is responsible for following traffic rules and all consequences of violations.

6. Use of the vehicle

  • The vehicle is used carefully and not driven under the influence of alcohol, drugs or medication that affects driving ability.
  • Smoking in the vehicle is not allowed.
  • The vehicle is not used for competitions, sub-rental to third parties or on unpaved roads or routes unsuitable for a classic 2CV.
  • Pets only in consultation and provided the interior is adequately protected.

7. Mileage, fuel & maintenance

  • Day rental includes 150 free kilometres. Additional kilometres are charged according to the confirmation.
  • The vehicle is provided with a full tank and must be returned with a full tank. Otherwise, fuel and service costs (minimum €15) will be deducted from the deposit.
  • The Renter treats the car with respect for its classic character and reports any irregularities or faults to the Lessor immediately.

8. Condition of vehicle at handover

  • At the start of the rental, the Lessor and Renter inspect the vehicle together. Existing damage and particulars are recorded; the Renter confirms the condition of the vehicle at key handover.
  • At return, the vehicle is inspected again together. Damage or defects not recorded at the start are considered to have occurred during the rental period and are at the Renter's expense, unless the Renter can demonstrate otherwise.
  • The Lessor records the condition of the vehicle at handover and return (including photographs). The Renter agrees to this procedure.

9. Insurance, damage & breakdown

  • The vehicle is covered by third-party/comprehensive insurance under the Lessor's policy; policy terms are available on request.
  • In case of damage, accident, theft or breakdown: call the Lessor immediately on 06-83250898 and follow instructions. A police report is required for third-party damage.
  • The Renter is liable for damage to the vehicle that occurs during the rental period. Repair costs are charged to the Renter, up to a maximum of the security deposit for normal use.
  • In case of damage resulting from prohibited use (driving under the influence, off-road use, participation in competitions, etc.), insurance coverage lapses and all costs are fully payable by the Renter, without limitation to the deposit amount.
  • Damage not reported immediately to the Lessor may be considered the Renter's fault; the Renter may then not be entitled to the standard claims process.
  • In case of breakdown due to a technical fault (not attributable to the Renter), the Lessor arranges roadside assistance. The Renter must not carry out repairs without the Lessor's permission.

10. Cancellations & rebooking

  • Cancellations or rebookings must be submitted in writing (by email to info@toereendfriesland.nl). The cancellation date is the date of receipt by the Lessor.
  • More than 14 days before the rental date: free cancellation, full refund of the rental sum.
  • 7 to 14 days before the rental date: 50% of the rental sum is due; the other 50% will be refunded.
  • Less than 7 days before the rental date: the full rental sum is due; no refund.
  • Rebooking to another date (same season, subject to availability) is free of charge once, up to 14 days before the rental date. After that, the cancellation terms above apply.
  • Bad weather does not entitle the Renter to cancel or receive a refund. The Lessor is happy to discuss an alternative date, but is under no obligation to do so.
  • The Lessor reserves the right to cancel a booking in case of force majeure (e.g. technical failure, emergency). In that case the Renter will receive a full refund or an alternative date.

11. Fines, costs & liability

  • Traffic fines, tolls, parking costs and other costs incurred by the Renter are payable by the Renter. For fines received, 10% administration costs apply and are charged to the Renter after the rental period.
  • The Lessor is not liable for indirect or consequential damages to the Renter or third parties as a result of use of the vehicle, to the extent permitted by law.
  • The Lessor is not liable for damage to belongings of the Renter or passengers in or around the vehicle.

12. Gift Cards

  • Gift Cards are valid until the date shown on the card and redeemable according to the instructions on the website and confirmation.
  • When a gift card is redeemed for a drive, these terms apply in full, including the security deposit (€250 per rented Duck).
  • Gift cards cannot be exchanged for cash and are non-transferable without the Lessor's permission.

13. Privacy

Personal data is processed in accordance with our privacy statement and is used exclusively for the performance of the agreement and customer service.

14. Applicable law & disputes

These terms and the rental agreement are governed by Dutch law. Disputes are preferably resolved by mutual agreement. If that is not possible, they will be submitted to the competent court of the District Court of Noord-Nederland.
